Terms and Conditions of Membership

Agreement to Terms and Conditions

​

This document sets out the terms and conditions of membership of the Premium Health Plan (formerly known as Healthy Dog Club) and the Basic Health Plan (the “contract”). By completing and submitting your Premium Health Plan or Basic Health Plan registration you confirm that you are the legal owner of the dog(s) listed on your registration form and that you wish to enter into a contract for membership of the Premium Health Plan or Basic Health Plan with VET ITC LTD, trading as Vet in the City (“The Company”, “Vet in the City”, “we”, “us” or “our”) subject to these terms and conditions.

We are registered in England and Wales under number 13492951. Our registered office is atC10 - 94 Wallis Road, London, E95LN.

Please read the terms and conditions carefully. If you have questions concerning these terms or any aspect of our service, you are required to raise these questions with Vet in the City prior to completing your registration.

Changes to the Agreements

​

We reserve the right, from time to time, with or without notice to you, to change these Terms and Conditions at our sole discretion. The Terms and Conditions applicable to your access to and use of this website will be the version that is current and displayed on the website as at each date you access the website.

Your Annual Service

Premium Health Plan

As part of your Premium Health Plan membership, you are entitled to receive the following benefits for the Dogs(s) named on your subscription:

  1. Trusted veterinary support and advice.

  2. Annual booster vaccination (including DHP, Leptospirosis and Kennel Cough).

  3. Monthly flea, tick, worm and lungworm products, including application or administration.

  4.  Quarterly tapeworm worm products, including administration.

  5. Monthly health and weight assessments conducted by a RCVS Veterinary Surgeon with a health report.

  6. Pamper package; nail clipping (without sedation), ear cleaning and anal gland expression as required or requested.

  7. Microchip placement and registration if needed and regular checking to make sure it's working.

 

Basic Health Plan

As part of your Basic Health Plan membership, you are entitled to receive the following benefits for the Dogs(s) named on your subscription:

  1. Twice yearly veterinary health assessments with reports in a familiar and positive environment for your dog.

  2. Annual booster vaccination (including DHP, Leptospirosis and Kennel Cough).

  3. Monthly flea, tick, worm and lungworm products.

  4. Quarterly tapeworm worm products.

Instructions

​

We cannot accept instructions from anybody under the age of 18 years. We understand that requests may be made by persons acting as your agent, such as pet carer, doggy day-care owner, kennel owner. It is assumed, unless advised in writing by yourself, that they have your authority and are acting in your interest and on your behalf. Requests for account details to be changed must be made in writing by the account holder.

General

a) There is no insured benefit. THIS IS NOT AN INSURANCE POLICY.
b) The Service is not an emergency service and is not intended to replace your primary veterinary practitioner. If you think you need emergency assistance, you should take your dog to the nearest emergency veterinary practice.
c) As part of the service, we are mandated to collect essential information relating to your pet. This includes but is not limited to contact details of your primary veterinary practice and your emergency contact details. This is in accordance with the Royal College of Veterinary Surgeons code of Professional Conduct.
d) Your Premium Health Plan or Basic Health Plan is not transferable to other dogs.
e) For the avoidance of doubt Vet in the City have discretion as to the medications and treatments provided under the terms of this agreement.
f) All notices given to Vet in the City under the provisions of this agreement must be in writing.
g) For the purposes of the Contracts (Rights of Third Parties) Act 1999 this agreement is not intended to, and does not, give any person who is not a party to it any right to enforce any of its provisions.
h) Vet in the City shall only be liable for any loss or damage suffered by you which is a reasonably foreseeable consequence of a breach of this Agreement.

i) Vet in the City’s total liability to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the Contract shall be limited to the total fees paid under the Contract.

Term

​

Your membership of the Premium Health Plan or Basic Health Plan will begin upon completion of your registration through our website site and/or the Collar app. 

Your Premium Health Plan membership is subject to a 30-day trial period, during which no membership fees will be collected. Once the trial period is over. Your membership is subject to a monthly membership fee charged at the beginning of every month thereafter.

Your Basic Health Plan membership is based on a minimum 6 monthly term. If  you wish to cancel within the 6 month time frame then a fee will be incurred to recoup the costs of parasite control that has been dispensed in advance. The maximum possible charge for cancellation is £120 (6 months at £20/month).

Termination

​

You are entitled to withdraw from this Agreement within 30 days of registration. You must exercise your right of withdrawal by written notice to the Vet in the City. This does not affect your statutory rights.

Once the 30 days trial period has ended, Vet in the City requires one month’s notice prior to termination. You agree to provide such notice or pay one month’s membership fee. You may cancel with notice at any time; there is no minimum term of contract.

Should your dog be deemed to be unsuitable due to medical or behavioural reasons, we reserve the right to cancel the membership with immediate effect.

Payments

​

By entering this agreement, you agree to pay a monthly membership fee, collected at the beginning of every month. The payment is collected automatically by our service provider Collar LTD, using your payment method on file. Other charges might be collected occasionally to cover extra medication or treatments administered to your pet. 

If for any reason, your payment collection fails, you will be notified by us or our service provider Collar LTD. If the outstanding fee is not collected within 14 days of the payment due date, we reserve the right to suspend the provision of goods and services to you until you have paid the overdue sum in full. Should you fail to do so within 30 days of the payment due date, Vet in the City shall be entitled to terminate your membership.

We reserve the right to an annual increase of the monthly membership fee. You will be notified of such a price increase 30 days prior to pricing changes taking effect. If you do not agree with the increase, you may terminate your membership with immediate effect by notifying Vet in the City in writing within 2 weeks of receiving the notice of the increase.

It is your responsibility to ensure your current account has sufficient funds to pay the charges. We shall not be responsible for any additional charges which may be imposed on you by your bank or card issuer. On termination of the Contract for any reason you shall immediately pay us all of Vet in the City’s outstanding unpaid invoices and interest and, in respect of services supplied but for which no invoice has been submitted, we shall submit an invoice, which shall be payable by you immediately on receipt.

All Charges include VAT unless otherwise stated.

 

We process all payments through our service provider Collar LTD. By signing up to Vet in the City’s Healthy Dog Club you are also agreeing to Collar LTD’s terms and conditions.

Payment references to your monthly charges will appear on your bank statement as a payment to Collar LTD with reference “COLLARUK” or “COLLARVITC”.​

Non-Registered Pets

​

We are unable to answer queries made by owners whose animals are not under our veterinary care as this is considered unethical by the Royal College of Veterinary Surgeons.

Complaints procedure

​

We aim to offer you a professional, friendly and efficient service and we hope that you will be pleased with the work we do for you. However, should a difficulty arise, our approach is to be constructive. Every complaint will be taken seriously, will be investigated thoroughly and promptly and remedial action will be taken as appropriate. Force Majeure

​

We will not be liable to you for any lack of performance, or the unavailability or failure of this website or our services, or for any failure by us to comply with these Terms and Conditions, where such lack, unavailability or failure arises from any cause reasonably beyond our control.

Written Communications

​

Applicable laws require that some of the information or communications we send to you should be in writing. When using our service, you accept that communication with us will be mainly delivered electronically through email, in-app messaging or both. We might contact you occasionally to provide you with information and updates to our service. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information, and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Transfer of Rights and Obligations

​

The contract between you and Vet in the City is binding on you and us and on our respective successors and assignees. You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

Intellectual Property

​

The content of the website, including graphics, data, information, text, images, design, logos, links, software and source code are protected by copyright, trademarks, database and other intellectual property rights. All rights, including copyright, in the content of the pages of the website are owned and controlled by us. You may retrieve and display the content of the website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy, broadcast, download, store (in any medium), show, play in public, adapt, change in any way or distribute or use for commercial purposes any of the materials or content on the website without our prior written permission.

If you post comments on the Products or Services to any website, blog or social media network (Commentary) you must ensure that such Commentary represents your fairly-held opinions. By subscribing to the Services you irrevocably authorise us to quote from your Commentary on our site and in any advertising or social media outlets which we may create or contribute to.

Data Protection

Vet in the City as administrators of this service, and Collar LTD as data processor, take your privacy very seriously and take great care to comply with its obligations under the Data Protection Act 2018 and to protect your personal information including any financial details that you provide. We will only use your personal information to administer the Premium Health Plan or Basic Health Plan which may include providing details to our partner day care’s. We may need to disclose or share your personal information with regulatory authorities for the purpose of fraud prevention and/or to comply with any legal or regulatory requirement.

If you have any questions about the way Vet in the City uses your personal information you can review our privacy notice or write to us. From time to time Vet in the City may wish to use the details you have provided to advise you of associated products which are important to your animal’s welfare and of potential interest as a pet owner. If you do not wish to be informed of these please notify Vet in the City of your preference by contacting us.

Environment

As a business we are aware of the environmental demands of modern day life and as such have instigated a number of green initiatives, including reducing the amount of paper we use.

Governing Law

​

Your use of this website is governed by these Terms and Conditions and construed and enforced in accordance with the laws of England and Wales. Disputes arising from your use of this website and the services we provide are subject to the non-exclusive jurisdiction of the courts of England and Wales.
